Healthcare professionals who use free note-taking applications for clinical content are creating Business Associate Agreement requirements - any software that handles protected health information requires a BAA with the software provider under HIPAA. Free consumer note-taking applications typically do not offer BAAs and are explicitly not intended for clinical use. Using them for clinical notes may constitute a HIPAA violation regardless of the company’s general security practices.

Legal professionals handling privileged information have confidentiality obligations that extend to the systems used to store client information. But they are the questions that the word “free” should prompt, because free is not a neutral description of a business model. It is a description of where the visible price point is - which is not the same as where the actual cost is.
